As indicated in previous correspondences, it is not the Council’s mandate to review a judicial decision to determine if the judge made the correct findings. The Council cannot change a judgement, reconsider evidence or determine the outcome of a matter. The judge’s legal conclusions and decisions do not constitute issues of judicial conduct and do not fall within the ambit of the Council to review. This role more appropriately belongs to the courts at the appellate level.
