This program brought together judges of the Provincial Court of New Brunswick, the Court of Queen’s Bench of New Brunswick and the Court of Appeal of New Brunswick. It focused on criminal law with an emphasis on the social context of sexual assault trials, general evidentiary issues in criminal trials, trial management skills, sentencing and Gladue reports, joint submissions on sentencing, and Supreme Court of Canada updates.

Overview

This program brought together judges of the Provincial Court of New Brunswick, the Court of Queen’s Bench of New Brunswick and the Court of Appeal of New Brunswick. It focused on criminal law with an emphasis on the social context of sexual assault trials, general evidentiary issues in criminal trials, trial management skills, sentencing and Gladue reports, joint submissions on sentencing, and Supreme Court of Canada updates.

Objectives

The objective of this seminar was to enhance the participants’ substantive knowledge and practical skills in: managing evidentiary issues in criminal trials; helping participants manage sexual assault trials with an improved awareness of social context; providing an understanding of the law and social context of sentencing, and reviewing key jurisprudential developments in criminal law.

Summary

Trial judges, Crown prosecutors, and defence lawyers led this program, which included dedicated sessions on sexual assault trials (social context, substantive, evidentiary and procedural issues); the law on consent and mistaken belief in consent; intoxication; prior consistent statements; and testimonial accommodations. Other sessions focused on more general evidentiary and procedural issues occurring in criminal trials.
