This program focused on case law updates and judicial settlement conferencing.

Objectives

The objectives of this seminar were to review important case law and practice updates, and to enhance participants’ skills in settlement conferencing.

Summary

This program was led by experienced senior judges who provided updates on recent case law and practice in family law, touching judicial continuity in family law proceedings, costs awards in family law matters, dealing with objections to affidavit material, and judicial intervention in foreclosure proceedings. The balance of the program was an intensive, “hands on” learning experience in settlement conferencing led by an experienced academic and senior judges acting as small group facilitators. Using a framework case study throughout the sessions, participants examined the theoretical and ethical framework for settlement conferencing and put the framework into action with demonstration vignettes and role-playing session designed to enhance settlement conferencing skills in “learn by doing” exercises.
