This seminar was divided into specialized programs for the General Division and the Family Division. The General Division session focused on sentencing, corrections and incarceration in criminal law. The Family Division session focused on challenging family law cases when mental ill-health is present, the role of the Manitoba Public Guardian and Trustee and judicial wellness.

Overview

This seminar was divided into specialized programs for the General Division and the Family Division.  The General Division session focused on sentencing, corrections and incarceration in criminal law.  The Family Division session focused on challenging family law cases when mental ill-health is present, the role of the Manitoba Public Guardian and Trustee and judicial wellness.

Objectives

The objectives of the Family Division portion of this seminar were to enhance participants understanding of mental ill-health in family law cases and to provide practical tools in cases in which mental ill-health is present, to increase understanding of the role of the Manitoba Public Guardian and Trustee and tools to increase and maintain judicial wellness.  The objectives of the General Division portion of this seminar were to enhance participants understanding of the experience of incarceration and the myths and assumptions of incarceration as they relate to sentencing challenges for judges in criminal proceedings.

Summary

Led by a multi-disciplinary faculty with judges, lawyers and academics, participants in the Family Division session gained an enhanced understanding and social context concerning the prevalence of mental ill-health in Canada; what a mental health diagnosis means in terms of symptoms and behaviour; how to effectively communicate with an individual with mental ill-health in the courtroom; the roles of a litigation guardian and the Public Guardian and Trustee; and effective tools to increase and maintain judicial wellness.

Participants in the General Division session attended two correctional facilities to learn about their operations from intake to release, the units within the facilities and the programs offered. With a multi-disciplinary faculty, participants explored the social context of sentencing and corrections services in sessions addressing myths and assumptions, the differences between provincial and federal facilities and the specific needs of offenders with mental ill-health.
