Council cannot review the manner in which a judge exercised their judicial discretion in the conduct of a case for the purpose of intervening in the judicial process.

20160019 - Council cannot review the manner in which a judge exercised their judicial discretion in the conduct of a case for the purpose of intervening in the judicial process. Nor can Council change a judge’s findings of fact and law. The Council has no jurisdiction to determine if a judge has made errors in the interpretation of the facts and law, or to review the process of judicial decision-making. This role more appropriately belongs to the courts at the appellate level. Council has no authority to refer a court case to another judge.
