20160023 - A complainant wrote to complain about court proceedings. He explained that an ex parte motion was filed for the custody of his son. He was contacted by the court during the ex parte motion and participated via telephone for a portion of the hearing. He advised that he did not understand what was happening and he was uncomfortable answering questions without legal representation. He felt ambushed. The complainant was informed that an ex parte interim order without prejudice was granted by the judge. One of the most important duties of a judge is to assess credibility and make findings of fact about the evidence presented at a hearing. The judge made a ruling on the interim order with which the complainant did not agree. That is not an indication of bias. Disagreement with the findings made by the judge must be raised before the courts. The Council has no authority to examine a judge’s decision or to assess the correctness of a decision.
