Impartiality is a fundamental qualification of a judge and core attribute of the judiciary. It is key to our judicial process and is presumed. The presumption of impartiality carries considerable weight. The person who alleges bias must be in a position to demonstrate the apparent lack of impartiality of the judge. This requires credible evidence and cannot rest on a mere allegation. Personal opinion or disagreements with the judge’s decisions are not evidence of bias or malice. A judge’s decisions pertaining to the acknowledgement of receipt of complaints or other correspondences is purely an administrative matter which falls under the authority of the judge and does not raise issues of conduct.
