It is not for the Council to review the judicial decision-making process or the manner in which judges exercise their judicial discretion in the conduct of a case. This includes, amongst other things, the judges’ legal and procedural decisions as well as their assessment of the evidence. In such situations, the best course of action for judicial decision-making cases is an appellate review and not the filing of a complaint with the council. It was determined that this matter does not warrant further consideration by the Council.
