20160010 - The complainant alleges that the judge lacked ethics and judgment. More specifically, the judge, in refusing a second adjournment, stated that he rely on jurisprudence and precedent to grant summary judgment. The complainant alleged that this would violate the legislation and the principles of procedural fairness and natural justice, disregard the contentious issues, and make errors of law that would lead to an unfair and undemocratic decision by the Court of Appeal. In this matter, the mandate of the Council is limited to reviewing and analysing the conduct of judges. Judicial decisions are not considered issue of conduct, and the Board does not have the power to review a judgment to determine whether it is well-founded. Henceforth, the complainant should seek action from the Appeal Court and not from Council.
