An Inquiry Committee of the Canadian Judicial Council recommends the removal of Justice Michel Girouard

Ottawa, 6 November 2017–The Inquiry Committee reviewing the conduct of Justice Michel Girouard has presented its report to the Canadian Judicial Council. The Inquiry Committee has expressed the unanimous view that a recommendation by the Council for Justice Girouard’s removal is warranted.

The Inquiry Committee reviewed four allegations of misconduct against the judge, each of which took issue with the truthfulness of the judge’s testimony under oath and his integrity. The Committee found that the misconduct particularized in three of the four allegations fall within ss 65(2)(b) and ( c) of the Judges Act, is extremely serious, and mandates a recommendation for removal from office. 

Council will now consider the Inquiry Committee’s report, after giving Justice Girouard an opportunity to make written submissions.

After considering all the issues, Council will decide on a recommendation to make to the Minister of Justice of Canada in this matter.
