Objective

The objective of this seminar was to provide judges with comprehensive training on the evidentiary, procedural, and substantive law challenges that arise in criminal jury trials, from pre-trial conferencing through to the taking of the verdict. 

Summary

Led by experienced judges with expertise in this area, and delivered by using a combination of short presentations and panel discussions, this seminar covered topics including: the impact of R. v. Chouhan on jury selection procedure, including the use of the standby power and expanded challenges for cause; the principles of party liability in trials of co-accused; instructing a jury on consent and mistaken belief in communicated consent in sexual assault cases; and tips for narrowing issues and focusing the trial.
