Decision of the Committee of Inquiry into the conduct of the Honourable Michel Déziel

Ottawa, 12 March 2015 – The Canadian Judicial Council's Inquiry Committee regarding the Honourable Michel Déziel has rendered its decision in this matter. After reviewing all of the information and considering relating circumstances, the Committee stated in an oral ruling that Justice Déziel should not be removed.

In supporting this decision, the Committee noted the implausibility of some of the allegations. While the Committee noted that some of Justice Déziel's actions did constitute misconduct as defined in the Judges Act, when mitigating circumstances were taken into account, that misconduct was not so serious as to render the judge incapacitated or unfit to continue to perform his judicial duties. 

In accordance with Council's Inquiries and Investigations By-Laws, the Committee will present a written report to the Council, which will then meet in plenary to consider the case. The judge and Independent Counsel will have the opportunity to submit additional written comments.

It will then be for the Council to submit a recommendation to the Minister of Justice.
